change of circumstances
In domestic relations law, condition used to show need for modification of custody or support orders. Betts v. Betts, 18 Or.App. 35, 523 P.2d 1055.
With reference to custody issues, this term refers to a change relevant to the capacity of the moving party or custodial parent to properly take care of the child. It must be a change which was not contemplated at the time of the original decree and which has occurred since the last custody order and would enhance or have an adverse impact on the welfare of the child. Matter of Marriage of Padbury, 46 Or.App. 533, 612 P.2d 321, 322.
This term is also used interchangeable with "changed circumstances."
